1. Acceptance of Terms
By downloading, installing, or using FeinLens ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and FeinLens ("we," "our," or "us"), the operator of the App.
We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.
2. Service Description
FeinLens is an AI-powered mobile application that provides:
- Outfit analysis and color harmony scoring
- Style classification and recommendations
- Wardrobe management features
- Occasion-based outfit suggestions
The App uses artificial intelligence to analyze photos and provide style feedback. Results are generated by AI algorithms and should be considered as suggestions, not professional fashion advice.
2.1 Service Availability
We strive to maintain App availability but do not guarantee uninterrupted access. The App may be temporarily unavailable due to scheduled maintenance, technical issues, third-party service disruptions, or force majeure events.
3. Account Registration
To use certain features of the App, you must create an account. You agree to:
- Provide accurate and complete information
- Keep your login credentials secure
- Notify us immediately of unauthorized access
- Be responsible for all activity under your account
You must be at least 13 years old (or 16 in the EEA) to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions & Payments
4.1 Subscription Plans
FeinLens offers the following subscription options:
- Standard: $3.99/month or $29.99/year
- Pro: $7.99/month or $59.99/year
Prices may vary by region and are subject to change with notice.
4.2 Free Trial
We offer a 7-day free trial for new subscribers. Your payment method will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.
4.3 Billing
- Subscriptions are billed through your Apple App Store or Google Play account
- Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
- You can manage and cancel subscriptions in your device's account settings
4.4 Refunds
Refund requests are handled by Apple or Google according to their respective refund policies. We do not directly process refunds. Contact Apple App Store or Google Play support for refund requests.
5. Acceptable Use
You agree NOT to:
- Use the App for any illegal purpose
- Upload content that is offensive, harmful, or violates others' rights
- Attempt to reverse engineer, decompile, or hack the App
- Use automated systems or bots to access the App
- Interfere with or disrupt the App's operation
- Impersonate others or provide false information
- Upload content that contains malware or harmful code
- Violate any applicable laws or regulations
Warning: Violation of these rules may result in immediate account termination without refund.
6. Intellectual Property
All intellectual property rights in the App, including but not limited to software code and algorithms, design elements and user interface, logos, trademarks, and branding, and content and documentation are owned by or licensed to FeinLens.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.
7. User Content
You retain ownership of photos and content you upload to the App. By uploading content, you grant us a limited license to:
- Process your photos for AI analysis
- Store wardrobe data to provide App functionality
- Display your content back to you within the App
We do not use your photos for marketing, training AI models, or share them with third parties beyond what is necessary for App functionality (see Privacy Policy).
7.1 Content Guidelines
You are responsible for ensuring your uploaded content does not infringe on others' intellectual property rights, does not contain illegal, harmful, or offensive material, and complies with all applicable laws.
8. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
We disclaim all warranties, express or implied, including:
- Merchantability and fitness for a particular purpose
- Accuracy or reliability of AI-generated recommendations
- Uninterrupted or error-free operation
- Compatibility with all devices or operating systems
AI-generated style recommendations are suggestions only and should not be considered professional fashion advice. Results may vary and are subjective.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or goodwill
- Damages arising from your use or inability to use the App
- Any third-party content or services
Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by law.
10. Termination
We may terminate or suspend your account immediately, without prior notice, if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Abuse or harass other users or our staff
You may terminate your account at any time through the App settings. Upon termination, your access to the App will be revoked, your data will be deleted according to our Privacy Policy, and no refunds will be provided for unused subscription periods.
11. Governing Law
These Terms are governed by the laws of Germany, without regard to conflict of law principles.
For EU consumers: Nothing in these Terms affects your statutory rights under EU consumer protection laws. Any disputes shall be subject to the jurisdiction of the courts of your place of residence.
For other users: Any disputes shall be resolved in the courts of Germany.
